Terms of Service

These Terms of Service (“Terms”) govern your access to and use of the SAN News Intelligence application (“the App”), provided by FactualIQ, a Nebraska corporation (“we”, “us”, or “our”). By signing in with Google and using the App, you agree to be bound by these Terms. If you do not agree, please do not use the App.
1. Eligibility
You must be at least 13 years old (or the minimum age required in your jurisdiction) to use the App. By using the App, you represent that you meet this requirement and that the information you provide is accurate.
2. Account and Authentication
The App uses Google authentication to sign you in. By signing in with Google, you authorize us to access the basic profile information and email address associated with your Google Account, as described in our Privacy Policy. Our use and transfer of information received from Google APIs will adhere to the Google API Services User Data Policy, including the Limited Use requirements.
You are responsible for maintaining the security of your Google Account and for all activity that occurs under your account.
3. Acceptable Use
You agree not to:
- Use the App for any unlawful, harmful, or fraudulent purpose.
- Attempt to gain unauthorized access to the App, its systems, or other users’ accounts.
- Interfere with or disrupt the integrity or performance of the App.
- Reverse engineer, decompile, or attempt to extract the source code of the App, except as permitted by law.
- Use the App to transmit malware, spam, or any malicious content.
4. Intellectual Property
The App and its original content, features, and functionality are owned by us and are protected by applicable intellectual property laws. These Terms do not grant you any right to use our trademarks, logos, or branding without prior written permission.
5. User Content
You retain ownership of any content you submit through the App. By submitting content, you grant us a limited license to use, store, and process that content solely for the purpose of providing and improving the App’s services.
6. Order of Precedence
If your organization has entered into a Master Services Agreement or other written agreement with us governing use of the App (“MSA”), the MSA controls in the event of any conflict with these Terms, including with respect to data use, ownership, retention, and deletion.
7. Third-Party Services
The App relies on third-party services, including Google authentication. Your use of those services is subject to their respective terms and policies. We are not responsible for the practices of any third-party service.
8. Termination
We may suspend or terminate your access to the App at any time, without notice, if you violate these Terms or if we discontinue the App. You may stop using the App at any time and revoke the App’s access via your Google Account permissions.
9. Disclaimer of Warranties
The App is provided on an “as is” and “as available” basis, without warranties of any kind, either express or implied. We do not warrant that the App will be uninterrupted, error-free, or secure.
10. Limitation of Liability
To the maximum extent permitted by law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the App.
11. Changes to These Terms
We may update these Terms from time to time. Any changes will be posted on this page with an updated “Last updated” date. Your continued use of the App after changes take effect constitutes acceptance of the revised Terms.
12. Governing Law
These Terms are governed by and construed in accordance with the laws of the State of Nebraska, without regard to conflict of law principles. Any dispute arising under these Terms shall be resolved in the state or federal courts located in Nebraska, except as otherwise provided in an applicable MSA.
